1. Acceptance of Terms
Welcome to BloomHub. By accessing or using BloomHub, you agree to be bound by these Terms of Service. If you do not agree to these Terms, you may not access or use BloomHub. BloomHub provides educational, therapeutic, screening, resource creation, and productivity tools designed to support therapists, educators, schools, caregivers, and related professionals.
2. Eligibility
You must be at least 18 years old to create an account and use BloomHub. By using BloomHub, you represent that you have the authority to enter into these Terms and that all information you provide is accurate and current.
3. Educational and Informational Use Only
BloomHub is intended for educational, informational, productivity, and professional support purposes only. BloomHub does not provide medical, occupational therapy, speech-language pathology, psychological, legal, educational placement, or healthcare services. Any information, recommendations, screeners, assessments, AI-generated content, activities, reports, visuals, or resources generated through BloomHub are provided for informational purposes only and should not replace professional judgment, evaluation, diagnosis, treatment planning, legal advice, or clinical decision-making. Users remain solely responsible for verifying the accuracy, appropriateness, and applicability of any content generated by BloomHub.
4. User Accounts
Users are responsible for maintaining the confidentiality of login credentials, restricting access to their account, ensuring account information remains accurate, and all activities occurring under their account. BloomHub reserves the right to suspend or terminate accounts that violate these Terms.
5. Subscription Plans and Billing
BloomHub may offer Free Accounts, Professional Monthly or Annual Subscriptions, and District or Organizational Licenses. Subscription fees are billed in advance and are non-refundable except where required by law. Subscriptions automatically renew unless canceled before the renewal date. Users may manage subscriptions through their account settings or billing portal. BloomHub reserves the right to modify pricing with reasonable notice.
6. Free Trials
BloomHub may offer free trial periods. At the end of the trial period, access may be reduced or terminated unless the user upgrades to a paid plan. BloomHub reserves the right to modify or discontinue trial offers at any time.
7. Intellectual Property and Commercial Usage Restrictions
BloomHub and all associated software, designs, workflows, logos, trademarks, graphics, content, proprietary screeners, templates, databases, AI systems, and platform features are the exclusive property of BloomHub and its licensors. This includes, but is not limited to, the specific phrasing and structure of our screeners, templates, and proprietary methodologies. BloomHub grants users a limited, non-exclusive, non-transferable, and revocable license to access and use BloomHub for personal, professional, or team-based clinical and educational practice within the BloomHub platform. Users may not copy, harvest, scrape, extract, sell, license, distribute, lease, reproduce, reverse engineer, or commercially exploit BloomHub proprietary content, screeners, wording, templates, workflows, methodologies, or platform features outside the scope of their licensed use. Any unauthorized commercial use or creation of derivative products constitutes a breach of these Terms and may result in account termination and legal remedies.
8. User Content
Users retain ownership of content they upload or create within BloomHub. By submitting content to BloomHub, users grant BloomHub a limited license to store, process, display, and use that content solely for operating and improving the platform. BloomHub does not claim ownership of user-created content.
9. AI-Generated Content
BloomHub may generate recommendations, activities, reports, visuals, strategies, or other content using artificial intelligence. AI-generated content may contain inaccuracies, omissions, or errors. Users are responsible for reviewing, editing, and validating all generated content before use. BloomHub makes no guarantee regarding the accuracy, completeness, or suitability of AI-generated outputs.
10. School and District Data
Users are responsible for ensuring compliance with applicable laws, regulations, school policies, and organizational requirements when entering information into BloomHub. Users should avoid entering unnecessary personally identifiable information or protected health information unless specifically authorized and compliant with applicable privacy requirements.
11. Prohibited Uses
Users may not violate any applicable laws, attempt unauthorized access, disrupt platform operations, upload malicious software, impersonate another individual or organization, or use BloomHub for unlawful, fraudulent, or harmful purposes.
12. Disclaimer of Warranties
BloomHub is provided on an as-is and as-available basis. BloomHub makes no warranties, express or implied, regarding availability, reliability, accuracy, fitness for a particular purpose, or uninterrupted operation. Use of BloomHub is at the user's own risk.
13. Limitation of Liability
To the fullest extent permitted by law, BloomHub, its owners, affiliates, employees, contractors, and licensors shall not be liable for indirect damages, consequential damages, lost profits, lost data, business interruption, or professional decisions made using BloomHub content. BloomHub's total liability shall not exceed the amount paid by the user to BloomHub during the twelve months preceding the claim.
14. Termination
BloomHub may suspend or terminate accounts that violate these Terms or pose a risk to the platform, its users, or its operations. Users may cancel their accounts at any time.
15. Changes to These Terms
BloomHub may update these Terms periodically. Continued use of BloomHub following changes constitutes acceptance of the updated Terms.
16. Governing Law
These Terms shall be governed by the laws of the State of Illinois, without regard to conflict of law principles.
